PURCHASE CONDITIONS

In accordance with the provisions of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSICE), the following information is provided: Cristina Otero Sabio (Akris Photography & Painting), with NIF: 76652746W and business activity in the sale of prints and other reproductions, original paintings, and crafts. General Contracting Procedure

The contracting procedure may only be carried out in Spanish. If it can be conducted in another language, this will be indicated before the contracting process begins.
For the purchase contract of products in our shop to be valid, the information provided by the user when placing an order must be accurate, complete, and up to date at all times. Failure to do so constitutes a breach of the terms, which may result in the termination of the contract with Akris Photography & Painting.
Order Validation
Once the purchase has been made, Akris Photography & Painting will immediately send the user an order confirmation by email. If the customer does not agree with the details provided in the confirmation, they may request a modification or cancellation of the order.
In any case, the request for cancellation or modification must be made within five working days from the order confirmation, via email to akrisworld@gmail.com, and only if the order has not yet been dispatched.

Prices

The applicable prices for each product are those indicated on the website on the date of the order. Prices are expressed in euros (€) and include the applicable VAT (Value Added Tax) in Spain. However, in accordance with the provisions of Law 37/1992 of 28 December on Value Added Tax, the transaction may be exempt from or not subject to this tax depending on the buyer’s country of residence and their status (business/professional or private individual). As a result, in certain cases, the final order price may differ from the one displayed on the website.
The invoice is issued upon dispatch and is accessible and downloadable from the user account, in addition to being sent in PDF format with the shipping confirmation email.
Validity of Prices and Offers
The products offered on the website, along with their prices, will remain available for purchase as long as they are displayed and visible on the website. Users are advised to access updated versions of the website to avoid pricing errors. In any case, orders in progress will retain their conditions for seven days from the time of confirmation.

Payment methods

The user/buyer agrees to pay for the products purchased from Akris Photography & Painting using the accepted payment methods and for any additional amounts (including taxes). Akris Photography & Painting accepts the following payment methods:

1. Bizum
2. Credit and debit card.
3. PayPal

Once the purchase has been made, a confirmation of the contract will be sent to the email address provided. This confirmation will serve as proof of the transaction (“Proof of Contract”) along with a link to these general terms and conditions of sale, as well as the return policy. The purchase confirmation and proof will not be valid as an invoice, which will be issued once the order is dispatched.

Delivery Conditions

All items in the shop will indicate stock availability when selecting their attributes. Confirmed and paid orders will be dispatched every week on Tuesdays and Thursdays before 16:30. In case of any issues with delivery times, the customer will be informed by customer service, always offering the best solution and the option to cancel the order if desired. Cancellations, Returns, and Withdrawal

Order Cancellation
An order can only be cancelled if it has not yet been dispatched. To cancel an order, an email must be sent to akrisworld@gmail.com, providing the order reference that needs to be cancelled. The refund will be made using the same payment method chosen at the time of purchase.

The product, due to its characteristics, does not include any support or assistance service for its use. Akris Photography & Painting assumes no responsibility for the misuse of products purchased on this website, and specifically, Akris Photography & Painting is exempt from any liability for personal or other types of damage that may occur as a direct or indirect consequence of the misuse of any product purchased from this website. This does not apply to defects or faults in the product from the manufacturer, in which case Akris Photography & Painting is obliged to resolve the issue by refunding the amount or sending a replacement product.

Through these General Terms and Conditions, no intellectual or industrial property rights are transferred over the Akris Photography & Painting portal or any of its constituent elements. The User is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available to the public, extracting, reusing, forwarding, or using any of them in any way or by any means, unless legally permitted or authorised by the holder of the corresponding rights.
The User acknowledges and agrees that the entire website, including but not limited to texts, articles, images, designs, software, content (including structure, selection, organisation, and presentation of the same), audiovisual material, and graphics, is protected by trademarks, copyright of Cristina Otero Sabio (Akris Photography & Painting), and other registered legitimate rights, in accordance with international treaties to which Spain is a party, as well as other property rights and laws of Spain.

Akris Photography & Painting reserves the right to modify, at any time, the presentation and configuration of the website, as well as these General Terms and Conditions. Therefore, Akris Photography & Painting recommends that all users read them carefully every time they access the website. Those contracting any of the services offered on this website will always have access to the General Terms and Conditions in a visible location, freely accessible for any consultation they wish to make.
If any clause of these General Terms and Conditions is declared invalid, the remaining clauses will remain in effect and will be interpreted in accordance with the parties’ intentions and the very purpose of these General Terms and Conditions.
Akris Photography & Painting may choose not to exercise any of the rights and powers granted in this document, which will not imply a waiver of the same, unless expressly acknowledged by Akris Photography & Painting or the prescription of the corresponding action in each case.

Applicable Law and Jurisdiction

These Terms of Use are governed by Spanish law. These Terms of Use are subject to the provisions of Law 7/1998, of 13 April, on General Terms and Conditions of Contract, Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users and other complementary laws, Law 7/1996, of 15 January, on the Regulation of Retail Trade, and Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce.
In accordance with Article 29 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, contracts concluded electronically in which a consumer is a party will be presumed to have been concluded in the place of their habitual residence. Therefore, in the event of any dispute arising from these general terms and for the resolution of conflicts, the parties submit to the courts and tribunals of the User’s domicile.
Likewise, electronic contracts between entrepreneurs or professionals, in the absence of an agreement between the parties, will be presumed to have been concluded in the place where the service provider is established.
